“October 6, 2018 started out as a wonderful day. I had just closed on the home I built the day before and my son, Kevin, and I were preparing for the movers to come the next day to move us to our new home. As night fell and the new day was approaching, my nightmare began when I received the call that the police had Kevin detained on his friend’s steps around the corner from our home. I couldn’t fathom what could have occurred during the short time span from Kevin leaving our home to walk around the corner to a friend’s house and him encountering the police. We soon learned from the police that an elderly man was robbed and shot while working at a gas station over a mile away. The police ignored obvious discrepancies in the suspect’s description to make it fit Kevin. After a flawed one man line up on the street surround by cops, I was told that a witness identified Kevin as the shooter. He was arrested and later booked on attempted murder and gun charges. Kevin’s charges were later upgraded to felony murder when the victim died.

That night as my son was taken into custody, I walked the streets with my mom trying to find cameras that would show that the police were wrong. The next day I began the process of calling lawyers to defend my son. During that process, Kevin was assigned a public defender to his case who showed up to the jail. I met with his public defender to fire her since I wasn’t going to allow my sons future to be in the hands of a public defender. During that conversation, she convinced me to give her a chance. The next day at his arraignment, she scored big points when she had me meet with private investigators. 

When I walked into the PI’s office, I was greeted by Miranda Whealan and advised that she would be handling Kevin’s case. I wasn’t impressed at first because I felt that she looked to be around my sons age, which had me questioning her experience to handle such a big case. My son was innocent and deserved the BEST! Miranda proved by her words and actions to be just that. Although I could tell by the questions asked that she had the knowledgebase to handle the case, it was the look in her eyes as I told our story that settled my mind and spirit. I knew at that point that she was going to do everything within her power to help me bring my son home and she confirmed that with her words. So many people, family included, questioned my word due to my being his mother and the image that the police and media were portraying about the case and my son. Miranda put all the innuendos to the side and heard our story without judgement. 

From that point on we were in constant contact about the case. Within that 1st week, Miranda called and said, “we got it.” It was the call that I had been praying about. Miranda had found video evidence of Kevin walking while on his cell phone from our home 11 mins after the murder occurred, which showed that it was impossible for him to have committed the crime. I thought that was the end of the story and he was coming home, but the wasn’t the case. They kept my son another five weeks on the murder unit because they refused to admit their wrongdoings. I can say without a shadow of a doubt that if Kevin’s attorney did not hire Miranda and the PI firm to handle the investigation, Kevin would still be sitting in a jail cell. I know for a fact that I have my son back in part due to the work that Miranda put in and for that I will forever be grateful!”

I had the opportunity to train Miranda Whealan when she attended the Criminal Defense Investigation National Academy. I also had the opportunity to personally observe her function at the highest level in all areas of the investigation process. The following is an example of the curriculum that she successfully completed.

COMPONENT METHOD:

1. Participants engaged the philosophy and methodology of criminal defense

Investigation as a specific specialized discipline. Topics of study included, duties and responsibilities as an agent of counsel, attorney-client privilege, work-product doctrine, developing legal theories, lead generation & development, fact classification and the case management process.

2. The Component Method was presented as an action plan to facilitate a

comprehensive approach to the investigative process. The Component Method consists of the following components: Forensic Case Review & Analysis, The Defendant Interview, Crime Scene Examination, Impeachment/Background Inquiries, Witness Interviews, Documentation & Report Writing

FORENSIC TESTIMONIAL EVIDENCE RECOVERY (FTER):

This course introduces the concepts of FTER - Forensic Testimonial Evidence Recovery. The study regiment builds upon and enhances theories and concepts of investigative interviewing covered in the introductory Component Method training. Investigative interviewing discussed as it relates to the process of criminal defense. Practical issues, such as the significance of sworn statements and witness interviewing strategies, are covered, as are the purpose and theory behind Kinesic interviewing, cognitive interviewing, standard law enforcement

interviews, and visual imagery techniques. Other practical and theoretical issues relevant to the role of the criminal defense investigator are also addressed. The significance of interviewing to obtain "testimonial evidence" from a forensic perspective is emphasized.

Ms. Whealan is a CDITC National Investigation Academy graduate. I would recommend her for an investigative position with any organization seeking to invest in the future of a quality professional.
